According to Us Weekly attorney Ronald Richards is urging Erika Jayne’s team to pay the missing $25 million to Tom Girardi’s lawsuit.
“I
gave her a week to just voluntarily return the money, but she never
did,” Richards told the outlet. “I can’t get into the settlement
discussion, but we are trying to resolve the case with her attorney.
This is the $25 million that [Girardi’s] law firm paid on behalf of
Erika to cover her expenses over a 12-year period.”
Erika’s attorney, Evan C. Borges, confirmed that he has been in contact with Richards and his team.
“Regarding
settlement discussions, those are supposed to be confidential between
counsel. It appears that my opposing counsel Mr. Richards has been
discussing publicly what he calls settlement discussions,” Borges said.
“Here’s the truth: Mr. Richards has reached out and told me that he and
the trustee want to settle. I have listened and will continue to listen.
That’s it.”

“I
can’t say enough that based on the evidence and law, Erika does not
have liability for any of the claims against her,” Erika’s lawyer added.
“All the claims against Erika amount to efforts to blame her for the
actions of others, including Girardi Keese and Tom Girardi.”
Richards said he was hopeful that the matter can be resolved easily so that no more money is wasted on legal fees.
“I would rather have her pay the victims than her lawyers,” he said.
“She
absolutely can file for bankruptcy, but I don’t think she would want to
do that,” Richards added. “No one is pressuring her, and there is no
reason for her to do that.”

On the second to last episode of the season, Erika Jayne claimed she was completely broke.
“I’m
out here rebuilding my life but, girl, I have zero dollars,” she told
Kyle Richards. “And by the time those trustees are done, there’ll be
nothing. So, I walk out of this with nothing.”
“Nobody wants to
see themselves with nothing,” Kyle said in a confessional. “But
obviously the victims here are the ones that need to be paid the money.
It’s plain and simple.”
Erika then said that those who are judging her have no clue what she’s going through.
